The prejudice ruling could be interpreted as the entire case was bogus or not, its lawyers who need to argue, but the case did have jurisdiction arguments in it. Futures companies are the beneficiary of this more than the CFD companies because it can reinforce an argument that simulation does not fall under jurisdiction of the CFTC. CFD's have other restrictions that could still leave that argument up in the air but it is unlikely the CFTC will pursue this argument...Ignored
