Terms of Service
The information, products, and services ("Services") hosted on and from cryptocraft.com are provided by Fair Economy, Inc. ("FEI"), located at 100 North Tampa Street, Tampa, Florida 33602, United States. By using FEI's Services, users of the Services ("Users") are agreeing to all of the following terms.
Services Usage
Users must follow any policies made available to Users within the Services.
Users may not misuse Services. For example, Users are not permitted to interfere with Services or try to access them using a method other than the interface and the instructions that FEI provides. Users may use Services only as permitted by law.
FEI may suspend or stop providing Services to Users who do not comply with terms or policies, or if FEI is investigating suspected misconduct.
Using FEI's Services does not give Users any ownership of any intellectual property rights in the Services, or the content Users access. Users may not use content from FEI's Services unless Users obtain permission from its owner or are otherwise permitted by law. These terms do not grant Users the right to use any branding or logos used in FEI's Services.
FEI's Services are designed primarily for experienced traders. Trading is potentially profitable for educated and experienced traders, however, there is considerable exposure to financial risk when trading. FEI makes no endorsement of trading, and does not intend to influence Users to trade or alter their trading approach. FEI and its affiliates cannot be held liable for trading decisions based on information hosted on or from the cryptocraft.com website.
FEI may email Users service announcements, administrative messages, and other information. Users may opt out of some of those communications.
Member Account
Users may need to obtain a member account ("Account") in order to use all Services.
Users are responsible for protecting their Account by keeping their password confidential. Users are responsible for the activity that happens on or through their Account. Users should not reuse their Account password on third-party applications. If Users learn of any unauthorized use of their password or Account, they should immediately contact FEI.
User-Generated Content
Some Services allow Users to submit existing content. Users retain ownership of any intellectual property rights that they hold in that content. What belongs to Users stays theirs.
When Users upload or otherwise submit content to FEI's Services, Users give FEI a worldwide license to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations, or other changes FEI makes so that User content works better within Services), communicate, publish, publicly perform, publicly display and distribute such content. The rights Users grant in this license are for the limited purpose of operating, promoting, and improving Services, and to develop new ones. This license continues even if Users stop using FEI's Services.
If Users have an Account, FEI may display their username, uploaded photos, and actions taken on FEI. FEI will respect the choices Users make to limit visibility via their Account settings.
FEI's Services display some content that is not FEI's. This content is the sole responsibility of the entity that makes it available. FEI may review content to determine whether it is illegal or violates FEI's policies, and FEI may remove or refuse to display content that FEI reasonably believe violates FEI's policies or the law. However, that does not necessarily mean that FEI reviews all content.
FEI responds to notices of alleged copyright infringement and terminates accounts of repeat infringers according to the process set out in the United States Digital Millennium Copyright Act.
As an interactive computer service, FEI is provided immunity by the United States Congress in Section 230 of the Communications Decency Act of 1996 from being held responsible for material published to the FEI website by Users. Users will be held solely responsible for the content of anything they post. If a User posts libelous, defamatory, slanderous, or otherwise untruthful remarks about a person or company, they may be putting themselves in legal jeopardy.
Modifying Services
FEI is constantly changing and improving Services. FEI may add or remove functionalities or features, and FEI may suspend or stop a Service altogether.
Users can stop using FEI's Services at any time. FEI may also stop providing Services to Users at any time, or add or create new limits to FEI's Services at any time.
Warranties and Disclaimers
FEI provides Services using a commercially reasonable level of skill and care. However, the following outlines things which FEI does not promise about the Services:
OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS OR ADDITIONAL TERMS, NEITHER FEI NOR FEI'S AFFILIATES, SUPPLIERS, OR DISTRIBUTORS MAKE ANY SPECIFIC PROMISES ABOUT THE SERVICES. FEI DOES NOT MAKE ANY COMMITMENTS ABOUT THE CONTENT WITHIN THE SERVICES, THE SPECIFIC FUNCTIONS OF THE SERVICES, OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET USERS' NEEDS. FEI PROVIDES ALL SERVICES "AS IS."
SOME JURISDICTIONS PROVIDE FOR CERTAIN WARRANTIES, LIKE THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. TO THE EXTENT PERMITTED BY LAW, FEI EXCLUDES ALL WARRANTIES.
Liability for Services
WHEN PERMITTED BY LAW, FEI, AND FEI'S AFFILIATES, SUPPLIERS, AND DISTRIBUTORS, WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF FEI, AND ITS AFFILIATES, SUPPLIERS, AND DISTRIBUTORS, FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT USERS PAID FEI TO USE THE SERVICES (OR, IF FEI CHOOSES, TO SUPPLYING USERS THE SERVICES AGAIN).
IN ALL CASES, FEI, AND ITS AFFILIATES, SUPPLIERS, AND DISTRIBUTORS, WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.
Business Use
If Users are using Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify FEI and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys' fees.
About These Terms
These terms were last updated February 2023.
FEI may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to FEI's Services. Users should look at these terms regularly. FEI will update the date at the start of this section when the terms are modified.
Changes to these terms will not apply retroactively and will become effective no sooner than 28 days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If Users do not agree to the modified terms for a Service, Users should discontinue use of all Services.
If it turns out that a particular term is not enforceable, this will not affect any other terms.
The laws of Florida, United States, will apply to any disputes arising out of or relating to these terms or FEI's Services. All claims arising out of or relating to these terms or the Services will be litigated exclusively in the federal or state courts of Hillsborough County, Florida, United States, and Users and FEI consent to personal jurisdiction in those courts.
Privacy Policy
The information, products, and services ("Services") hosted on and from cryptocraft.com are provided by Fair Economy, Inc. ("FEI"), located at 100 North Tampa Street, Tampa, Florida 33602, United States. In the process of using FEI's Services, users of the Services ("Users") may provide information that is collected by FEI. This policy explains how FEI stores and uses that information.
Information Collected
FEI collects and uses information, including Personal Information, to provide better services to all Users – from determining basic information, such as which country a User is connecting from, to more complex information, like how a User navigates the FEI website ("Site").
Personal Information ("Information") is information that Users provide to FEI which personally identifies them, such as a name, email address, or other data that can be reasonably linked to such information by FEI, such as information FEI associates with Accounts.
Users may deliberately provide Information to FEI. For example, many Services require Users to create a member account ("Account"), which requires Users to provide a valid email address. Users may also add Information to their member profile, including where they live, their occupation, name, age, or other data that can be reasonably linked to such information by FEI.
FEI collects information about Users' activity on our Site, such as browsing history, search history, and information regarding Users' interaction with our Platform and other websites. FEI uses various technologies to collect and store location information, including cookies, pixels or pixel tags, local storage, such as browser web storage or application data caches, databases, Session Replay, and server logs. FEI may also collect anonymous Information from Users without their explicit consent. For example, FEI may collect information about the Services that Users use and how they use them, which device the User is using (such as hardware model, operating system version, and unique device identifiers), and which keywords Users' search.
Session replay provides FEI with the ability to replay a visitor's journey on a web site or within a mobile application or web application. Replay can include the user's view (browser or screen output), user input (keyboard and mouse inputs), and logs of network events or console logs. Session replay is used to help improve customer experience, analyze usability, and help identify obstacles in conversion processes on websites. It can also be used to study a website's usability, customer behavior, interests, and the handling of customer service questions as the customer journey, with all interactions, can be replayed. It can also be used to analyze fraudulent behavior on websites.
FEI may collect and store information locally on Users' devices using mechanisms such as browser web storage (including HTML 5) and application data caches. FEI uses various technologies to collect and store information when Users visit a Service, and this may include sending one or more cookies or anonymous identifiers to Users' devices.
Users may set their browser to block all cookies, including cookies associated with FEI's Services, or to indicate when a cookie is being set by FEI. However, many Services may not function properly if Users' cookies are disabled.
FEI hosts banner advertisements from third-party advertisers. These banner ads may collect anonymous information and set cookies on Users' devices. FEI does not control how this information is collected or stored. The privacy policy for information collected by third-party advertisers may be found on the advertisers' websites.
Information Uses
FEI uses Information from all Services to provide, maintain, protect and improve them, to develop new ones, and to protect FEI and Users. FEI also uses Information to offer Users tailored content and ads.
When Users contact FEI, FEI may keep a record of Users' communications to help solve any issues Users might be facing. FEI may use Users' email addresses to inform them about Services, such as letting Users know about upcoming changes or improvements.
FEI uses Information to operate, maintain, supervise, administer, improve, and enhance the FEI website and related Services, features, and functionality. FEI uses User's contact information to communicate and interact with them, such as to send Users emails and text messages about FEI's Services. FEI uses the IP address assigned to User's devices to send Users the data they request to display on their devices. FEI uses unique identifiers stored in cookies on User's devices to help FEI authenticate Users as the person who should have access to certain areas and features of FEI's website. FEI also uses Information to ensure its websites are working as intended, such as tracking outages or troubleshooting issues that Users report to FEI. FEI also uses Information for research and development for FEI business, and to make improvements to its websites.
FEI uses data collected from Users and their devices for analytics and measurement to understand how its websites are used. For example, FEI analyzes data about User's use of FEI websites to accomplish tasks such as optimizing Services. FEI uses a variety of tools to do this, such as Google Analytics and similar third-party online data analytics services.
FEI partners with third-party advertising networks that collect IP addresses, unique device identifiers, browser type, operating system, time zone, country, referring pages, and other information through the use of cookies, pixel tags, and server logs on FEI websites. They use this information to provide Users with interest-based advertisements that are customized to their particular preferences, including for companies that are not affiliated with FEI. Users may see these interest-based advertisements on the FEI websites, as well as on third-party websites and apps, and across different devices Users use. FEI may use this process to help FEI manage and improve the effectiveness of FEI's marketing efforts. It also allows FEI to display ads to Users about FEI after they leave the FEI websites, to track Users after they see or click on an advertisement, keep track of Users who access FEI websites or advertisements from different devices, and better provide advertisements to FEI's target audiences. The data collected through these tracking technologies are also saved and processed by FEI's advertising and marketing service provider partners.
FEI uses information collected from cookies and other technologies to improve Users' experience and the overall quality of Services. When showing Users tailored ads, FEI will not associate a cookie or anonymous identifier with sensitive categories, such as those based on race, religion, sexual orientation, or health.
FEI will ask for Users' consent before using information for a purpose other than those that are set out in this policy.
FEI processes Information on servers in many countries around the world. FEI may process Information on a server located outside the country where Users live.
Information Sharing
FEI does not share Information with companies, organizations, or individuals outside of FEI, unless one of the following circumstances applies:
FEI may share Information with companies, organizations, or individuals if FEI has a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to meet any applicable law, regulation, legal process or enforceable governmental request.
FEI may share Information with companies, organizations, or individuals for operating and maintaining the FEI websites, and their features, functionality, and Services. These third parties include data hosting and data storage partners, analytics, ad network, advertising (including interest-based advertising), technology services and support, and data security.
FEI may share Information with companies, organizations, or individuals, including providers and vendors FEI uses for business activities and operations generally, such as data hosting and data storage partners, analytics, ad network, advertising, technology services, and support, and data security. FEI may also share Information with professional advisors, such as auditors, law firms, and accounting firms.
FEI may share Information with companies, organizations, or individuals to enforce applicable Terms of Service, including investigation of potential violations, detect, prevent, or otherwise address fraud, security or technical issues, or protect against harm to the rights, property or safety of FEI.
If FEI is involved in a merger, acquisition or asset sale, FEI will continue to ensure the confidentiality of Information and give affected Users notice before Information is transferred or becomes subject to a different privacy policy.
FEI may also use de-identified information, so that it cannot be reasonably used to identify any individual, with third parties for marketing, advertising, research, or similar purposes.
Users can generally opt out of receiving interest-based advertisements from third-party advertisers and ad networks who are members of the Network Advertising Initiative (NAI) or who follow the Digital Advertising Alliance's Self-Regulatory Principles for Online Behavioral Advertising by visiting the opt-out pages on the NAI website and DAA website. FEI does not control third parties' collection or use of Information to serve interest-based advertising. However, these third parties may provide Users with ways to choose not to have Information collected or used in this way. Users can also opt out of receiving targeted ads from members of the NAI on its website. You can learn more about interest-based advertisements and User's opt-out rights and options on the NAI website and DAA website.
If Users do not wish to have their email address used by FEI to send them advertising messages and content, Users can opt-out at any time by clicking the unsubscribe link at the bottom of any marketing emails Users receive from FEI. Users may have other options with respect to marketing and communication preferences through FEI's websites.
FEI restricts access to Information to FEI employees and contractors who need to know the information in order to process it for FEI, and who are subject to strict contractual confidentiality obligations and will be disciplined or terminated if they fail to meet these obligations.
