Yes, it's called slippage MFF was good at that. Once the news traders get some very bad fills during the news, they will stop. Besides there are ways to trade news profitably outside their 4 minute window. The rule is actually quite retarded.

Most of them lose minimal amounts of money so it's not that a big deal. Over 90% would have lost their funds in any case due to failing challenges. Those having funded accounts aren't losing any of their own funds.
