100% right, the broker has to demonstrate in court their claim and have the trader condamned to pay it. Undoable imo, and very unlikely they even try it. That's wrong. A company in liquidation can sue.

Oh Wookey, do you have a clue all the mentionned brokers are market makers ? They are the counterpart of all customers trades. You would be correct on an actual MARKET. I doubt they want to defend such a case in a court if law.
